Insurance Coverage and Fraud Investigation

The standard Massachusetts Automobile Insurance Policy requires that an insured cooperate with the insurer’s investigation, settlement, and defense of any claim or lawsuit. This requirement can include: 


  1. sending copies of all documents relevant to the claim;
  2. submission to an examination under oath; and
  3. for bodily injury claims, submission to a medical examination. 


Homeowner’s insurance policies also typically include these requirements. An insured’s failure to cooperate with insurer’s reasonable coverage investigation can result in denial of coverage.
